E-Consent Agreement

This Electronic Communications Consent Agreement ("E-Consent") governs your use of electronic signatures, records, and communications in connection with your use of SmartLendo (the "Platform"). This E-Consent is entered into pursuant to the Electronic Signatures in Global and National Commerce Act ("E-SIGN Act"), 15 U.S.C. § 7001 et seq., and applicable state electronic transactions laws.

1. Scope of Consent

By checking the consent box, clicking "Submit," or otherwise proceeding with your loan request, you expressly consent to receive the following communications electronically:

  • Loan request confirmation and status updates
  • Disclosures and notices required by federal or state law
  • Marketing and promotional communications (subject to your right to opt out at any time)
  • Loan documents, agreements, and disclosures provided by third-party lenders
  • These Terms and Conditions, Privacy Policy, and other Platform legal documents
  • Responses to any inquiries you submit to us

2. Electronic Signature Consent

You agree that your electronic signature – whether by clicking a button, checking a box, typing your name, or similar action – has the same legal effect, validity, and enforceability as a handwritten signature. You agree not to contest the validity of any agreement or document solely on the grounds that it was executed electronically.

3. Hardware and Software Requirements

To access and retain electronic communications, you will need:

  • A device capable of accessing the internet (computer, smartphone, or tablet)
  • A web browser that supports at least 128-bit encryption (such as a current version of Chrome, Firefox, Safari, or Edge)
  • An active email address that you regularly check
  • Software capable of viewing PDF documents (e.g., Adobe Acrobat Reader, available free at adobe.com)
  • Sufficient storage capacity to save or print electronic documents

You are responsible for maintaining hardware and software sufficient to access electronic communications. If our technical requirements change materially, we will update this section accordingly.

4. Requesting Paper Copies

You have the right to receive paper copies of any electronic communication. To request paper copies, please contact us at support@smartlendo.com and specify the document(s) you require. We may charge a reasonable fee for paper copies, not exceeding $5 per request, as permitted by applicable law.

5. Withdrawal of Consent

You may withdraw your consent to electronic communications at any time by contacting us at:

Withdrawal of consent will not affect the enforceability of any agreements executed electronically prior to your withdrawal. Please note that withdrawing consent may limit your ability to use certain features of the Platform, as electronic delivery is integral to our service.

6. Updating Contact Information

It is your responsibility to maintain an accurate, active email address with us. If your email address changes, please notify us promptly at support@smartlendo.com to ensure continued delivery of electronic communications.

7. Record Retention

We recommend that you save or print a copy of this E-Consent Agreement and all other electronic communications for your records. Electronic communications may not be retained indefinitely on our servers.

8. Your Ability to Access Disclosures

BY CLICKING THE LINK OR “I CONSENT,” YOU ASSENT TO THE TERMS OF THIS DISCLOSURE. YOU ACKNOWLEDGE THAT YOU CAN ACCESS THE DISCLOSURES IN THE FORMATS DESIGNATED ABOVE.

9. Consent

BY CLICKING THE LINK OR “I CONSENT,” YOU AGREE TO THIS E-CONSENT AGREEMENT AND OUR TERMS. YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS INFORMATION REGARDING ELECTRONIC SIGNATURES, RECORDS, DISCLOSURES, AND DOING BUSINESS ELECTRONICALLY. YOU CONSENT TO THE USE OF ELECTRONIC SIGNATURES AND TO RECEIVING ALL REQUIRED DISCLOSURES AND COMMUNICATIONS ELECTRONICALLY. YOU ALSO AGREE TO CONDUCT TRANSACTIONS ELECTRONICALLY WITH THIRD-PARTY LENDERS, WHERE APPLICABLE. YOU MAY REQUEST PAPER COPIES OF ELECTRONIC RECORDS AND DISCLOSURES AT ANY TIME BY CONTACTING US AT support@smartlendo.com. WE MAY CHARGE A REASONABLE FEE FOR PROVIDING PAPER COPIES, NOT EXCEEDING $5 PER REQUEST, AS PERMITTED BY APPLICABLE LAW. YOUR CONSENT TO RECEIVE ELECTRONIC DISCLOSURES IS NECESSARY TO USE OUR ONLINE SERVICES. IF YOU DO NOT AGREE, PLEASE DO NOT PROCEED OR USE THE PLATFORM.
